Transactions carried out on the platform can be settled using the following methods:

  • Bank transfer to the Operator's designated account
  • Electronic wallets (PayPal, PromptPay, TrueMoney, etc.)
  • Payment on delivery (if offered for certain products or geographic areas)

Debit is made upon activation of the service, unless otherwise specified during validation. All transactions are secured using encryption protocols that comply with international standards (SSL/TLS), and banking data is never stored by the Operator.

In the event of payment refusal, non-payment, or suspected fraud, the Operator reserves the right to suspend or cancel the order, without entitling the user to compensation.

ARTICLE 10 — Duration of Application and Termination of the Terms and Conditions

10.1. Duration of Application of These Terms and Conditions

These General Terms and Conditions of Use (hereinafter the "Terms and Conditions") come into effect upon the first interaction between the user and the PICKEENOO platform, whether it is a simple consultation, the creation of a profile, or a commercial transaction.

They remain applicable throughout the entire duration of use of the services offered by the Operator and remain enforceable as long as the user maintains active access to the platform, even in the absence of an order or publication.

Any substantial update to the Terms and Conditions will be subject to a visible notification on the platform or electronically. Continued use of the services after modification constitutes tacit acceptance of the new provisions.

10.2. Termination at the User's Initiation

The user may terminate their use of PICKEENOO services at any time, without justification, by one of the following methods:

Voluntary termination results in:

10.3. Termination Imposed by the Operator

The Operator reserves the right to unilaterally revoke access to the platform and terminate the user profile, effective immediately, in the following cases:

  • Serious or repeated breach of the contractual obligations defined in the Terms of Use
  • Fraudulent, abusive, or unethical digital behavior
  • Violation of the security, integrity, or reputation of the platform
  • Failure to comply with publication, payment, or confidentiality rules
  • Prolonged inactivity, defined as a total absence of interaction for a continuous period of 18 months

Imposed termination may be preceded by a warning or temporary suspension, depending on the severity of the incident. It does not give rise to any compensation, unless otherwise provided by law.

The Operator also reserves the right to temporarily block access to certain features or limit profile privileges in the event of suspicious or contentious behavior.

10.4. Legal and Technical Consequences of Termination

Permanent closure of the profile results in the following effects:

  • Irreversible deletion of all data associated with the account: personal information, order history, publications, preferences
  • Termination of access rights to the platform's services, content, and features
  • Extinction of user licenses granted to the user
  • Termination of contractual commitments, except for legal retention or prosecution obligations (billing, disputes, warranties)

  • Commercial or strategic adjustments related to changes in the business model, the integration of new partners, or the reorganization of services

This adaptability is inherent to the evolving nature of the platform and does not require prior consent from users. However, the Operator undertakes to ensure maximum transparency in communicating changes.

In the event of disagreement with the revised Terms and Conditions, the user has the option to:

  • Close their user profile, in accordance with the provisions of Article 10
  • Exercise their rights relating to personal data, if the changes affect the processing described in Article 7

Failure to respond or unsubscribe within 30 days of notification shall be deemed to constitute tacit acceptance of the new Terms and Conditions.

11.4. Version Management and Archiving

The Operator maintains a history of successive versions of the Terms and Conditions, accessible upon request, to ensure the traceability of contractual commitments. Each version is dated, referenced, and archived in accordance with legal obligations regarding evidence and compliance.

In the event of a dispute, only the version of the Terms and Conditions in effect at the time of the disputed event shall be deemed authentic.

In the event of a dispute, litigation, or disagreement concerning the interpretation, execution, or validity of these GTU, the parties undertake to seek an amicable resolution through direct negotiation before any legal action.

  • Internal mediation or private arbitration, if proposed by the Operator

The search for an amicable solution is considered a mandatory preliminary step, except in cases of emergency or clear violation of a party's rights.

12.3. Jurisdiction in the Event of a Dispute

Failing an amicable agreement within a reasonable time, any dispute shall be brought before the competent courts of the Kingdom of Thailand, and more specifically:

  • The Chiang Rai Civil Court, for commercial, contractual, or technical disputes
  • The Consumer Court, for disputes involving individuals in the context of a consumer relationship

This attribution of jurisdiction is exclusive, even in the event of multiple defendants or third-party claims. No foreign jurisdiction clause shall be binding on the Operator.

12.4. Consumer Mediation

In accordance with the provisions of the Thai Consumer Code, any user acting as a consumer may request out-of-court mediation from an authorized body or competent authority. This mediation may be initiated:

  • At the consumer's initiative, by written request
  • At the Operator's suggestion, in the context of an unresolved dispute
  • Via an online dispute resolution platform, if available

Mediation is free, confidential, and non-binding. It does not suspend the statutory time limits for appeal, unless expressly provided otherwise. In the event of failure, the consumer retains the right to refer the matter to the competent courts.

ARTICLE 13 — Miscellaneous Clauses

13.1. Entire Nature of the Contractual Agreement

These General Terms of Use (GTU) constitute the entire agreement between the user and OMWS, operator of the PICKEENOO platform, and supersede any prior commitment, statement, communication, or arrangement, whether oral or written, relating to the subject matter hereof.

No special conditions, additional provisions, or parallel agreements may prevail over the GTU, unless expressly stipulated in writing and validated by the Operator.

In the event of a contradiction between the GTU and any other contractual document (GTC, privacy policy, technical annexes), the provisions of the GTU shall prevail, unless otherwise stated.

13.2. Severability of Clauses

In the event that one or more provisions of these Terms and Conditions are declared void, inapplicable, or non-compliant with a legal or regulatory provision, this invalidity will in no way affect the validity, legality, or enforceability of the other clauses of the document.

The clause in question will be deemed unwritten and may be replaced by a legally equivalent provision, consistent with the parties' initial intention, without altering the overall balance of the contract.

This rule of severability guarantees the legal viability of the agreement, even in the event of legislative changes or partial litigation.

13.3. Tolerance and Non-Waiver

The Operator's failure to require strict performance of a provision of these Terms and Conditions, or to exercise a right or sanction provided for, shall not be construed as a definitive waiver of that right or provision.

Any occasional tolerance, exception, or adjustment granted to a user does not constitute an acquired right or an implicit contractual modification.

The Operator reserves the right to demand full compliance with the T&Cs at any time and to apply the measures provided for in the event of non-compliance.

13.4. Non-transferability of Rights and Obligations

The rights and obligations arising from these T&Cs are strictly personal to the user and may not be transferred, assigned, loaned, or delegated, whether free of charge or for a fee, without the prior, express, and written consent of the Operator.

Any request made in another language may be subject to additional delays due to translation or legal verification.

ARTICLE 15 — Final Provisions

15.1. Contractual Language

These General Terms of Use (GTU) are written in French, the official language of the contract between the user and the Operator. An English or Thai version may be provided for informational purposes or to facilitate understanding, but only the French version shall be deemed authoritative in the event of a dispute or difference of interpretation.

Any translation shall be deemed non-contractual, unless expressly agreed otherwise by the Operator.

15.2. Force Majeure

The Operator shall not be held liable for any failure or delay in the performance of its contractual obligations resulting from a force majeure event, as defined by case law and applicable Thai law. The following are considered cases of force majeure:

  • Natural disasters (floods, earthquakes, fires)
  • Labor disputes, internal or external strikes
  • Widespread network or technical infrastructure outages
  • Massive computer attacks or hacking
  • Unforeseen administrative or regulatory decisions

For the duration of the event, the Operator's obligations are suspended. If the situation persists beyond 60 days, either party may terminate the contract without compensation.

15.3. Archiving and Proof

Contractual data, browsing history, transactions, and electronic exchanges are securely archived by the Operator, in accordance with legal obligations regarding evidence, taxation, and compliance.

These elements may be produced in the event of a dispute and are deemed admissible before the competent courts. The user acknowledges that electronic records (logs, emails, confirmations) constitute valid evidence, equivalent to paper documents.

15.4. Interpretation of Clauses

In the event of any difficulty in interpreting the headings of the articles and their content, only the wording of the clauses shall prevail. Headings are inserted for convenience and shall not alter the legal scope of the provisions.

Any ambiguity shall be interpreted in light of the contractual intent of the parties, in accordance with applicable law and the commercial logic of the PICKEENOO platform.

  • Pirated or Unlicensed Software, Films, and Music
  • Fake Official Documents, Stamps, and Banknotes

c) Offensive or Immoral Content

  • Pornographic Publications or Obscene Material
  • Items Insulting the Monarchy, the Buddhist Religion, or Institutions
  • Content Inciting Hate, Violence, or Discrimination

d) Products from Protected Species

16.4. Seller's Liability and Due Diligence

Each seller is fully responsible for the legality of the products they offer on the platform. They undertake to:

  • Verify regulatory compliance before publication
  • Not conceal or falsify product characteristics
  • Provide supporting documents at the Operator's request
  • Comply with the prohibitions and restrictions listed in this article

The Operator cannot be held responsible for violations committed by sellers, but reserves the right to cooperate with the competent authorities in the event of a report or inspection.

16.5. Penalties for Non-Compliance

Any failure to comply with the provisions of this article may result in:

  • Immediate removal of the product concerned
  • Suspension or termination of the seller's profile without notice
  • Reporting to the competent authorities (police, customs, regulators)
  • Civil or criminal prosecution, depending on the seriousness of the offense

The offending user or seller may be required to reimburse buyers, compensate the Operator, and bear the legal consequences of their actions.
